NOTICE IS HEREBY GIVEN that the period for filing affidavits of candidacy for the office of school board member of Independent School District No 2860 shall begin on July 30, 2019, and shall close at 5:00 o'clock p.m. on August 13, 2019.

The general election shall be held on Tuesday, November 5, 2019. At that election, one (1) member will be elected to the School Board for a term of one (1) year.

Affidavits of Candidacy are available from the school district clerk, 315 East 6th Street, Blue Earth, MN 56013-2006. The filing fee for this office is $2. A candidate for this office must be an eligible voter, must be 21 years of age or more on assuming office, must have been a resident of the school district from which the candidate seeks election for thirty (30) days before the general election, and must have no other affidavit on file for any other office at the same general election.

The affidavits of candidacy must be filed in the office of the school district clerk and the filing fee paid prior to 5:00 o'clock p.m. on August 13, 2019.

URBAN CHICKENS

Subd. 1. Definitions.

1. Brooding means the period of chicken growth when supplemental heat must be provided due to the bird's inability to generate enough body heat.

2. Chicken means a domesticated bird that serves as a source of eggs or meat.

3. Coop means the structure for the keeping or housing of chickens permitted by the subsection.

4. Exercise yard means a larger fenced area that provides space for exercise and foraging for the birds when supervised.

5. Hen means a female chicken.

6. Nesting box describes a secure, clean, quiet place that the hen can access for the purpose of egg-laying, ideally allowing for easy daily collection of eggs by the permit-holder.

7. Rooster means a male chicken.

8. Run means a fully enclosed and covered area attached to a coop where the chickens can roam unsupervised.

Subd. 2. Investigation and enforcement. The City Council shall have authority in the investigation and enforcement this subsection, and no person shall interfere with, hinder or molest any such officer of the council in the exercise of such powers. The City Council shall make investigations as is necessary and may grant, deny or refuse to renew any application for permit, or terminate an existing permit under this article.

Limitations for each single dwelling residential unit.

(A) No more than six (6) chicken hens shall be housed or kept on anyone (1) residential lot in any area of the city with the permit as outlined below.

(B) Roosters are prohibited.

(C) A separate coop is required as a designated structure to house the chickens. Coops must be constructed and maintained to meet the following minimum standards.

(A) Located in the rear or side yard.

(B) Setback at least fifteen (15) feet from the rear or side property lines.

(C) Interior floor space must be adequate.

(D) Coop must allow access for cleaning and maintenance.

(E) Coop must allow for ventilation.

(F) Nest boxes - minimum of one (1) box per six (6) hens.

(G) Rodent-proof coop construction and materials must be adequate to prevent access by

rodents.

(H) Coops shall be constructed of durable materials that are compatible with the permitholder's structures and neighboring residential properties, coops should be maintained

in a workmanlike manner.

(I) May be portable.

(D) A run or exercise yard is required. Chickens must be confined to these areas at all times,

"free-ranging" is not allowed in the City of Frost.

(A) Runs must be constructed and maintained to meet the following minimum standards.

(A) Location: rear or side yard

(B) Size: No larger than 100 square feet.

(C) Accessibility: must allow human access to the run.

(D) Enclosure: adequate to keep hens in and predators out.

(E) Setback: at least five (5) feet from property lines.

(F) Substrate: composed of material that can be easily raked or regularly replaced to reduce odor and flies.

(B) Exercise Yards must be fenced in a manner that ensures containment of chickens within

the boundaries of the permit-holder's property.

(E) Chickens must not be housed in a residential house or an attached or detached garage,

except temporarily for brooding purposes only.

(F) All premises on which chicken hens are kept or maintained shall be kept clean from filth, garbage, and any substances which attract rodents. The coop and its surroundings must be cleaned frequently often enough to control odor. Manure shall not be allowed to accumulate in a way that causes an unsanitary condition. Litter and manure shall be removed often enough to prevent odors from being detectible on another property. Litter and waste shall not be placed in recycling bins. Failure to comply with these conditions may result in the removal of chickens from the premises or revoking of the chicken permit.

(G) All grain and food stored for the use of hens on a premise with a chicken permit shall be kept in a rodent proof container.

(H) Chicken hens shall not be kept in such a manner as to constitute a nuisance to the occupants of adjacent properties.

(I) Chicken living conditions must be maintained is such a manner to provide adequate care and safeguards for chicken health.

(J) Dead chickens must be disposed of according to the Minnesota Board of Animal Health rules, which require chicken carcasses to be disposed of as soon as possible after death, usually within forty-eight (48) to seventy - two (72) hours. Legal forms of chicken carcass disposal include offsite burial, offsite incineration or rendering, or offsite composting.

Subd. 3. Permit required. No person shall own, keep, harbor or have custody of any live chicken without first obtaining a permit in writing from the City. The applicant's signature on this permit will acknowledge the applicant's awareness of the minimum conditions required by the City of Frost; this signature represents the applicant's intent to maintain compliance with the regulations outlined in these ordinances. If citizen complaints are lodged against a permit holder, the permit may be reviewed and any violations will need to be remedied within a reasonable time frame to avoid revocation.

Subd. 4. Application. Any person desiring a permit required under the provisions of this article shall complete a written application to the city clerk upon a form prescribed by and containing such information as required by the city clerk and city council. Among other things, the application shall contain the following information:

A) A description of the property upon which it is desired to keep the chickens.

B) The breed and number of chickens to be maintained on the premises.

C) A site plan of the property showing the location and size of the proposed chicken coop and

run, setbacks from the chicken coop to property lines and surrounding buildings ( including houses and buildings on adjacent lots), and the location, style, and height of fencing proposed to contain the chickens in a run or exercise area. Portable coops and cages are allowed, but portable locations must be included with the site plan.

D) Statements that the applicant will at all times keep the chickens in accordance with all of the conditions prescribed by the city council, or modification thereof, and that failure to obey such conditions will constitute a violation of the provisions of this chapter and grounds for cancellation of the permit.

E) Such other and further information as may be required by the city council.

Subd. 5. Permit Conditions

A) If granted, the permit shall be issued by the city clerk under direction of the city council, and shall state the additional conditions, if any, imposed upon the permitted for the keeping of chickens under this permit. All permit-holders will be required to adhere to the regulations described in the City of Frost ordinances pertaining to "Urban Chickens."

B) The permits shall specify any further restrictions, limitations, conditions and prohibitions

which the city council deems reasonably necessary to protect any person or neighboring use from unsanitary conditions, unreasonable noise or odors, or annoyance, or to protect the public health and safety. Such permit may be modified from time to time or revoked for failure to conform to such restrictions, limitations, and prohibitions. Such modification or revocation shall be effective after the (10) days following the mailing of written notice thereof by certified mail to the person or persons keeping or maintaining such chickens.

C) The granting of a permit under this ordinance does not entitle the permit holder to any other rights as may be granted to farmers or commercial entities relating to equipment used in the course of conducting animal husbandry business. No person, business, or entity shall maintain or cause to be maintained any commercial business related to keeping of fowl on residential property unless otherwise permitted by the City of Frost.

Subd. 6. Fees/Issuance. For each residential site the fee for a permit may be imposed, set, established and fixed by the City Council, by resolution, from time to time.

Subd. 7. Term. The permit period under this section shall expire one (1) year from the date the permit is issued. Permits must be renewed on an annual basis.

Subd. 8. Revocation. The city may revoke any permit issued under this ordinance if the person holding the permit refuses or fails to comply with this ordinance, with any regulations promulgated by the city council pursuant to this ordinance, or with any state or local law governing cruelty to animals or the keeping of animals. Any person whose permit is revoked shall, within ten (10) days thereafter, remove live chickens being owned, kept or harbored by such person and their refuse from the property, and no part of the permit fee shall be refunded.

Subd. 9. Violations/Penalty.

A) Any person violating any of the sections of this ordinance shall be deemed guilty of a petty

misdemeanor.

B) If any person is found guilty by a court for violation of this section, their permit to own, keep, harbor, or have custody of chickens shall be deemed automatically revoked and no new permit may be issued for a period of one (1) year.

C) Any person violating any conditions of this permit shall reimburse the city of all costs borne by the city to enforce the conditions of the permit including but not limited to the pickup and impounding of chickens.
